Please read these Terms of Use (“Terms”) carefully. They are a binding agreement between you and Datasolids, Inc. (“Datasolids,” “we,” “us,” or “our”) governing your use of the Datasolids application, website, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Datasolids Is

Datasolids gives you a personal, patient-controlled health “pod” — a secure place that aggregates your health records from your healthcare providers, payers, and other sources you choose to connect. You decide what to connect, what to store, and whom to share it with. Datasolids acts at your direction, as your agent, to retrieve and organize your own health information.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of another person (for example, as a caregiver or authorized representative), you represent that you have the legal authority to do so and to agree to these Terms on their behalf.

3. Your Account

To use the Service you must create an account with accurate information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. We strongly recommend enabling multi-factor authentication. Notify us immediately at [security@datasolids.com] if you suspect unauthorized access.

4. Connecting Your Health Records

The Service lets you connect accounts at healthcare organizations (for example, through Epic MyChart and other electronic health record systems) using secure, industry-standard authorization (SMART on FHIR / OAuth 2.0). When you connect a provider:

5. Your Data, Privacy, and Security

Your health information belongs to you. Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms. We encrypt sensitive health identifiers at rest and protect data in transit. You control sharing: any access you grant to a clinician, organization, or research program is time-bounded and revocable by you.

6. Not Medical Advice

The Service is for informational and record-keeping purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Information shown in Datasolids may be incomplete, delayed, out of date, or contain errors originating from the source systems. Always seek the advice of your physician or other qualified health provider with any questions about a medical condition, and never disregard professional medical advice or delay seeking it because of something you saw in the Service. Do not use the Service for medical emergencies — call your local emergency number (such as 911 in the United States).

7. Acceptable Use

You agree not to: access or attempt to access any account or data that is not yours; misuse, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service; use the Service for any unlawful purpose; or upload content that infringes others’ rights. You may use the Service only for your own personal health information or that of someone you are legally authorized to represent.

8. Third-Party Services

The Service connects to third-party systems, including healthcare providers, electronic health record vendors (such as Epic), and payers. Those parties control the accuracy, availability, and completeness of the data they hold and operate under their own terms and privacy practices. Datasolids is not responsible for the content, accuracy, or availability of third-party systems or for any data they provide or fail to provide.

9. Intellectual Property

The Service, including its software, design, and content (excluding your health information and content you provide), is owned by Datasolids and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms. You retain all rights to your own health information.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data retrieved from third parties will be complete or accurate.

11. Limitation of Liability

To the fullest extent permitted by law, Datasolids and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (US$100).

12. Indemnification

You agree to indemnify and hold harmless Datasolids from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Upon termination, you may request export or deletion of your data as described in our Privacy Policy.

14. Changes to the Service and These Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in the Service). Your continued use after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution
